01The service
Photon is an online ID photo capture service that performs AI photo quality and composition checks and background removal. It is offered in three editions - Lite, Business and Enterprise - which differ in how the service is delivered and operated.
02Subscriptions, fees and payment
Photon Lite is sold on a self-serve annual subscription and is priced per user on graduated tiers with a minimum charge, plus a one-time setup fee. Photon Business is sold on a self-serve annual subscription, priced by volume band, and provided as a dedicated instance under ID-ware's Business service agreement. Photon Enterprise is arranged with our sales team. Lite and Business payments are processed by Stripe; we do not store card details on our own systems. Prices are as published on the pricing page at the time of purchase, and VAT is added where applicable.
03Free trial
Where offered, the Photon Lite free trial runs for 7 days and is limited to a maximum of 50 users. A payment method is collected when the trial starts; no charge is taken during the trial. Unless you cancel before the trial ends, your subscription begins and the first invoice (including any setup fee) is charged automatically.
04Cancellation and refunds
You can cancel a Lite or Business subscription at any time from the billing portal; cancellation takes effect at the end of the current billing period and you retain access until then. Winding down a Business dedicated instance also follows the terms of the Business service agreement. Fees already paid are non-refundable except where a refund is required by law: cancelling stops the next renewal, and no pro-rata refund is given for the remainder of the current term.
05Acceptable use
You agree to use Photon only for lawful purposes and not to misuse, disrupt or attempt to gain unauthorised access to the service.
06Availability and support
Service availability targets and support are set out per edition. Dedicated service levels apply to Business and Enterprise under their respective agreements.
07Data protection
We process personal data in accordance with our Privacy Notice. Photon performs face detection only for photo quality and composition; it does not perform facial recognition and does not store biometric templates.
08Liability
Neither party excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud. Subject to that, ID-ware's total aggregate liability arising out of or in connection with the service is capped at the fees you paid for the service in the 12 months preceding the event giving rise to the claim, and ID-ware is not liable for indirect or consequential loss, or for loss of profits, revenue, data or goodwill.
09Changes to these terms
We may update these terms from time to time. The current version will always be available on this page.
10Governing law and contact
These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction. Questions about these terms can be sent to sales@id-ware.co.uk.
